Privacy Policy Impact Auto Auctions Ltd. ("Impact") is committed to your right to privacy and to keeping your personal information private. Impact has therefore developed this Privacy Policy to ensure that your rights are protected.

Limiting Collection of Information

The collection of personal information is limited to that which is necessary for the purposes identified by Impact in this Privacy Policy. Information is collected by fair and lawful means.

Impact collects and maintains certain information about you and your business when you register with us and conduct business with us. The information you provide can identify you and your business and includes, but is not limited to, items such as driver's license number, your birth date, dealer registration number, and vehicle purchases and sales (e.g. type of vehicle, quantity, price, vehicle identification number, odometer reading, storageYear, make, model, date of purchase and/or sale, purchase and/or sale patterns), banking information, financial information and tax information. Some of the information collected by Impact may be "personal information" within the meaning of federal and/or provincial privacy laws.

Purpose of Collecting Personal Information

Impact collects, uses and discloses personal information for the following purposes:

  1. to process your application and related documents required to become a registered Impact customer and to make a decision regarding the acceptance or rejection of customer applications;
  2. to verify the information that you provide to us;
  3. to verify, evaluate and/or monitor your creditworthiness;
  4. to assist with the collection of any amounts owing by you to Impact;
  5. to contact you in response to any purchases, requests, complaints or comments you may have;
  6. to contact you to provide you with information regarding our business and sales;
  7. to help us to develop, evaluate and improve our sales and marketing strategies and techniques;
  8. to provide third parties with the personal information necessary to permit that third party to conduct business with Impact and/or effectively provide you with services including, but not limited to, vehicle transportation services etc.;
  9. to assist us and third parties in evaluating the vehicle remarketing industry;
  10. to respond to reasonable inquiries from regulatory, governmental, investigative and law enforcement agencies; and
  11. to maintain and update our banned dealer list.
We collect, use and disclose aggregated and individual sales data including sale location, pricing, odometer reading, vehicle condition, vehicle description and vehicle identification number information to assist us and third parties in evaluating market trends, to prepare data analyses, and to prepare market report and valuation products. We provide law enforcement and regulatory agencies with buyer or seller names and other information, some of which may be personal information. We may provide our banned dealer list (which includes the name and address of the affected business and the names of all individual representatives of the affected business whose privileges have been suspended, and the reasons for the suspension) to third parties including third party auctions.

Impact may share personal and/or aggregated information that you have provided to us with other business divisions within the KAR group of companies. Impact shares credit information concerning you with our sister company, AFC (Auction Finance Corporation).

Limiting Use, Disclosure and Retention

Personal information shall not be used or disclosed for purposes other than those for which it was collected, except with your consent or as required by law. Personal information shall be retained only as long as necessary for the fulfillment of those purposes or as required by law.


Whenever possible, Impact will seek your consent to use and disclose your personal information at the same time it collects such personal information. By providing your personal information to Impact, by conducting business at any of our auction sites or by using Impact's on-line services such as AuctionNow, you are consenting to the collection, use and disclosure of your personal information for the purposes set out in this Privacy Policy.

Accuracy and Corrections

Personal information shall be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used. If you would like to (a) update personal information previously submitted to Impact, (b) request to have outdated personal information removed, or (c) withdraw your consent to the use or disclosure of your personal information, please contact us by phone at (905) 896-9727 and ask to speak with Impact's legal counsel.


Impact has safeguards in place through the use of firewalls and password protected access to control access to your personal information and to ensure that your personal information is appropriately protected.


Impact will make readily available to customers specific information about its policies and practices relating to the management of personal information. Upon request, customers will be informed of the existence, use, and disclosure of his or her personal information and shall be given access to that information. Customers can challenge the accuracy and completeness of the information and have it amended as appropriate.

Amendments to Policy

Impact reserves the right to modify or amend this Privacy Policy at any time and for any reason. Any changes to this Privacy Policy will be preceded by a notice posted on our website at and/or by posting the changes at our auction site(s).
